Education Law

EDUCATION LAW

CML is a litigation firm. We don't shy away from filing a lawsuit when needed.

Education Law is one of the most complex practice areas, requiring in-depth knowledge and careful attention to detail. The Education Law attorneys at C. McKinley Law & Associates are experienced in this field and are strongly dedicated to ensuring that the rights of every Georgia student are upheld and protected.

Our Services

C. McKinley Law & Associates has expertise in the laws and regulations that govern federal and state schools, school boards, and school systems. With in-depth knowledge about the rights and protections guaranteed to students, we work hard to ensure that every student receives the treatment they deserve in educational settings. We represent and advocate for students and their families at tribunal hearings, Individualized Education Program (IEP) meetings, and Manifest Determination testing and hearings.

In addition, our firm works closely with parents and guardians in order to equip them with the tools and information they need to vigorously advocate for the needs and rights of their children at school.

Know Your Rights Training

C. McKinley Law & Associates provides Know Your Rights training to Parent Teacher Associations all across the state of Georgia. The purpose of this training is to work with the PTA to ensure the safety of students in public, private, and charter schools. We aim to protect K-12 students against harm by school district staff and personnel, including but not limited to Student Resource Officers (SRO), local police officers, and other public safety administering adults and representatives.

Our firm wants to make schools a safer space for all students by preventing the use of excessive force. We also want to support and enable every parent to act as an advocate for their children, working to enact safety and well-being policies, practices, procedures, and protocols.

CML’s Parent/Guardian Advocacy Checklist:

  • Request your child’s entire student file. Under FERPA, you have a constitutional right to see all documents related to your child while attending a public school.
  • A Tribunal Hearing must be in writing with reasonable notice pending a suspension longer than 10 days.

An IEP or 504 can be updated anytime during the school year upon request from you. C. McKinley Law & Associates can help you get one scheduled.
